Entry in the certificate of good conduct after a penalty order

Whether a penalty order appears in the certificate of good conduct depends on the level of the penalty. A single fine of up to 90 daily units or a custodial sentence of up to three months is – provided no further penalty is recorded – generally not entered in the ordinary certificate (§ 32 BZRG).

Why the threshold matters

Especially professionally, an entry can have considerable consequences. A forward-looking defence can work towards not exceeding the limit of 90 daily units.

Approach

We examine the penalty order, the daily units and the option of a limited objection. See ancillary consequences.
