Received a questionnaire for fraud
Anyone who receives a questionnaire (Anhörungsbogen) for an allegation of fraud (§ 263 StGB) is a suspect in an investigation. Personal details are mandatory, statements on the matter are voluntary – and should be withheld until file access has been obtained.
What it means in fraud cases
Cases often concern online or classifieds deals, undelivered goods or disputes over PayPal. Intent at the time the contract was concluded is decisive. Do not complete the form on the matter before the investigation file is known.
The right approach
We obtain file access under § 147 StPO and examine deception, error, loss and the evidence. The proceedings can often be discontinued or a penalty order avoided. See our page on fraud (§ 263 StGB).
