When a relative has been arrested and is in pre-trial detention, every hour counts. The sooner a defence lawyer is involved, the sooner they can obtain file access and influence the custody decision.
Court-appointed defence in custody matters
In pre-trial detention a court-appointed defender must be assigned (§ 140(1) no. 4 StPO), securing the defence regardless of means.
Review of detention and appeal
Against the arrest warrant, a review of detention (§ 117 StPO) and an appeal (§ 304 StPO) are available. Often a suspension subject to conditions is possible. See pre-trial detention in Bonn.
