As the victim of certain offences you may join the public prosecution as a joint plaintiff (Nebenkläger) and thus move from a mere witness to an active participant with your own rights.
Who may join as a joint plaintiff
Under § 395 StPO the joint plaintiff role is available in particular for sexual offences, bodily harm offences, attempted homicide, as well as stalking and deprivation of liberty. In homicide cases, close relatives may join.
Your rights as a joint plaintiff
As a joint plaintiff you have the right to be present, to ask questions, to make evidentiary applications and statements, and an independent right of appeal. In serious cases a lawyer is assigned to you under § 397a StPO – for certain offences regardless of your income, otherwise by way of legal aid.
